1. About these terms
These terms apply when you use Can I Eat on canieat.co.nz or in our iOS and Android apps (together, “the service”). By creating an account or using the service you agree to them. If you don’t agree, please don’t use the service.
Can I Eat is run from Aotearoa New Zealand. These terms are governed by New Zealand law, and nothing in them limits your rights under the Consumer Guarantees Act 1993 or the Australian Consumer Law where those apply.
2. General guidance, not medical advice
Can I Eat gives general food-safety and diet guidance based on published advice from authorities such as New Zealand Food Safety (MPI), Te Whatu Ora, Food Standards Australia New Zealand, RANZCOG, ASCIA, Coeliac New Zealand and Coeliac Australia. Every answer shows its source.
It is not medical advice and does not replace advice from your midwife, doctor, dietitian, pharmacist or allergy specialist. Ingredients, recipes and products change, and labels, menus and photos can be misread. Always check the label and ask the kitchen when it matters, and follow your health professional’s advice where it differs from ours.
If you think you are having a severe allergic reaction, call 111 in New Zealand or 000 in Australia. For urgent health advice, call Healthline on 0800 611 116 (NZ) or healthdirect on 1800 022 222 (AU).
3. Your account
You need a free account to use the service. Keep your sign-in details private; you are responsible for activity on your account. You must be at least 16, or have a parent or guardian’s permission.
You can delete your account at any time from Settings (web) or Profile (app). Deleting it removes your account and your synced data, as described in our privacy policy.
4. Free use and Plus
Checking foods, meals and barcodes, sources, safety guidance and the allergy card are free. We will never ask for payment details to use the free service, and we don’t show ads.
Can I Eat Plus is an optional paid upgrade. If you buy Plus in the iOS app, payment, renewal and cancellation are handled by Apple under the App Store terms; in the Android app, by Google Play; on the web, by our payment provider. Subscriptions renew automatically until cancelled at least 24 hours before the end of the current period. Free trials, where offered, convert to a paid subscription unless cancelled before they end. Refunds for app-store purchases are handled by the store.
5. Using the service fairly
Please don’t misuse the service: for example, don’t try to break or overload it, scrape it, get around usage limits, upload things that aren’t yours to share, or use it to harm anyone. We may limit or close accounts that do.
Photos and links you send for AI reading must be ones you’re allowed to share. Don’t include other people’s personal information in photos.
6. Our content
The app, its design and our written guidance belong to us or our licensors. Product data comes in part from Open Food Facts under the Open Database Licence. You may share individual answers for personal, non-commercial use.
7. Availability and changes
We work to keep the service available and accurate, but it may sometimes be unavailable or contain mistakes. We may change features, and we may update these terms; if a change is significant we will tell you in the app or by email before it takes effect.
8. Liability
To the extent the law allows, we are not liable for loss or harm arising from relying on general guidance in the service instead of checking the label, asking the kitchen or following professional advice. Where we are liable, our total liability is limited to the amount you paid us for Plus in the 12 months before the claim. Nothing in these terms excludes liability that cannot be excluded by law.
